1. Who We Are

These Terms of Service (“Terms”) govern your use of the Harmonic 639 mobile app, the harmonic639.com website, and any related services (together, “Harmonic 639”). Harmonic 639 is operated by Harmonic Frequencies LLC, a Texas limited liability company (“Harmonic Frequencies,” “we,” “us,” or “our”).

By creating an account or using Harmonic 639, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Harmonic 639.

2. Eligibility

You must be at least 13 years old to use Harmonic 639. If you are under the age of majority in your jurisdiction, you may use Harmonic 639 only with the involvement of a parent or guardian. Harmonic 639 is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

3. Your Account

You are responsible for the activity that happens under your account and for keeping your login credentials secure. Tell us promptly at hello@harmonic639.com if you suspect any unauthorized use.

You can delete your account at any time from inside the app or by emailing the address above. When you delete your account, we delete or anonymize your personal data on the schedule described in the Privacy Policy.

4. Subscriptions and Billing

Harmonic 639 is offered as a Premium subscription (“Premium”) with a 7-day free trial. Premium subscriptions purchased through the Apple App Store or Google Play Store are billed by Apple or Google respectively, not by Harmonic Frequencies.

• Auto-renewal. Premium subscriptions auto-renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the renewal date.
• Cancellation. You can cancel anytime in your Apple or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Free trials. If a free trial is offered, you will be charged the regular subscription price at the end of the trial unless you cancel beforehand.
• Refunds. Refunds for subscriptions purchased through the App Store or Play Store are handled by Apple or Google under their respective refund policies.
• Price changes. We may change subscription prices. We will give you notice before any price change takes effect; you can cancel before it does.

5. Content and License

All music, video, lyrics, audio, and other content provided through Harmonic 639 is owned by Harmonic Frequencies LLC or licensed to us. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to stream and listen to the content for your own non-commercial use through Harmonic 639.

You may not copy, download (except where the app provides offline functionality for personal use), redistribute, sell, sample, remix, or create derivative works from the content without our written permission.

6. Tracks You Create

Harmonic 639 lets you compose personalized tracks by sharing affirmations or what you're working through (“Custom Tracks”). When you create a Custom Track:

• You retain rights to the words you submit.
• You grant us a worldwide, royalty-free license to process those words for the purpose of generating, storing, and delivering your Custom Track to you.
• The musical composition of your Custom Track is owned by Harmonic Frequencies LLC and licensed to you for personal use under the same terms as the rest of the catalog.
• You may not submit content that is illegal, infringing, defamatory, hateful, or that violates anyone's privacy.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of Harmonic 639.
• Bypass authentication, paywalls, or any access controls.
• Use bots, scrapers, or automated tools to access the service.
• Use Harmonic 639 to harass, abuse, or harm others.
• Misrepresent your identity or impersonate anyone else.
• Interfere with or disrupt the service or its infrastructure.

We may suspend or terminate your access if you breach these Terms.

8. Wellness Disclaimer

Harmonic 639 is a music and personal-development product. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or psychological condition. The 639 Hz frequency, affirmation lyrics, and 21-day journeys are designed to support personal reflection and wellbeing. They are not a substitute for professional medical, mental health, or therapeutic care. If you are experiencing a medical or mental health concern, please consult a qualified professional.

9. Disclaimer of Warranties

Harmonic 639 is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Harmonic Frequencies LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from your use of Harmonic 639. Our aggregate liability for any claim arising out of or relating to these Terms or Harmonic 639 will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.

11. Changes to Harmonic 639 and These Terms

We may add, change, or remove features, content, or pricing at any time. We may update these Terms by posting a new version on this page and updating the “Last updated” date. Material changes will be communicated through the app or by email. Your continued use of Harmonic 639 after changes take effect constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of Harmonic 639 will be resolved exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.
